MARITAL MEDIATION FEE CONTRACT
THIS AGREEMENT is made between the parties signing below and

The parties, CLIENT A AND CLIENT B are advised that the Connecticut Bar Association requires written agreement whenever a client retains a lawyer for any purpose, and they thereby agree to the following:
We wish to define the terms of a Marital Agreement to help us stay married, as simply and as sensibly as possible. Each of us agrees to participate fully in this effort to define our future behavior in order to improve our marriage.
We agree to hire Name of Mediator at an hourly rate of
$_____ an hour plus costs. We agree to pay our mediator a retainer in the amount of $_____. We understand that the retainer shall be deposited in the Name of Mediator IOLTA trustee account. Any retainer amount that is remaining at the conclusion of our mediation shall be refunded to us. We agree to share the expense of the mediation equally from our joint account, or ____ % by CLIENT A and ____ % by CLIENT B.
We realize that our mediator shall not represent either or both of us as an attorney at any time in the connection with our Marital Agreement. During the mediation we agree to disclose all aspects of our financial situations. Each of us is free to consult his/her own advisors at any time.
We agree that all communications in mediation, including all notes, homework, draft contracts and other writings are completely confidential under this Contract. Neither of us can seek testimony of the mediator or disclosure of her file in connection with any court proceeding related to this Contract.
We realize that the mediator is in charge of the mediation process and she/he will give each of us equal time as much as possible, whether our sessions are together or separate, and she/he will not take sides other than to help guide us to a reasonable agreement designed to help us stay married. We realize that we are not required to mediate any issue or to reach agreement on any issue.
